The Washington DC Court of Appeals ruled 5-4 this morning to reject a bid to put marriage equality to a public vote.  The Human Rights Campaign reports via press release:

“The court’s ruling today is a significant victory for justice, the rule of law and the protection of all D.C. residents against discrimination,” said Human Rights Campaign President Joe Solmonese. “It’s time for the National Organization for Marriage to realize equality is here to stay no matter how much money they want to throw at turning back the clock.” In its decision, the Court of Appeals, D.C.’s highest court, decided 5-4 that the Council properly exercised its authority under the D.C. Charter in establishing the requirement that a proposed initiative may not authorize, or have the effect of authorizing, discrimination prohibited by the D.C. Human Rights Act.

The Court ruled unanimously that the proposed initiative would in fact impermissibly permit discrimination against gays and lesbians in the District. “The D.C. Council made a wise decision decades ago that no initiative should be permitted to strip away any individual’s civil rights. The Court unanimously found that the proposed anti-marriage initiative would have the effect of causing discrimination, and in doing so, stood up for the entire D.C. community,” said Solmonese.

The HRC notes that while Maryland-based Bishop Harry Jackson (above) is the person most connected with the bid to overturn gay marriage in DC, the driving forces behind the now-failed initiative were the Alliance Defense Fund and NOM. Another win for the good guys today and a big FAIL buzzer for Bishop Harry!

Chase Community Giving, a Facebook-centered initiative that allows users to vote on how JP Morgan Chase should disburse $5 million to nonprofits, lists the National Organization for Marriage’s Education Fund among some 650,000-and-counting eligible groups in the contest, as first reported by Queerty.

But a Chase spokesman asserted late Thursday that the antigay group headed by Maggie Gallagher is not eligible for charitable funds — even if it garnered sufficient votes — because it violates the contest’s nondiscrimination rules. The database of groups was generated by GuideStar, a third-party firm that provides research on nonprofit groups.

“Organizations that receive votes from the guidestar database will be reviewed to make sure that they’re in the compliance with all of our guidelines,” Joe Evangelisti, head of media relations for JP Morgan Chase, told The Advocate.

According to NOM’s website, its education fund “represents another aspect of NOM’s overall effort to protect marriage, engaged solely in pro-marriage education and research, making information resources available to clergy, scholars, political leaders, and activists across the country.”

The day before elections, Judge Walker, who is presiding over the federal challenge to Prop 8, held a hearing over a dispute concerning the proponents of Prop 8 and their unwillingness to hand over certain ordered internal campaign communications regarding messaging to the plaintiffs.

These documents are vital to the plaintiffs in their effort to prove that those responsible for Prop 8 are not concerned about the welfare of the state, traditional marriage or the weak argument of protecting procreation, but that they acted out of animus toward the LGBT population.

On November 11, Judge Walker ordered they hand over the documents, stating that they were not protected from disclosure.

Well, it gets better. They still haven’t handed over the documents. According to California attorney Rick Xiao at blog Proposition 8 and the Right to Marry:
Today Judge Walker dropped the hammer on Prop. 8 proponents and ordered immediate production of internal communications concerning their campaign strategies and messages to voters. Among other things, Judge Walker admonished Prop. 8 proponents that his previous discovery orders, while being appealed to the Ninth Circuit, remain in effect because the appellate court has not issued a stay. Thus, Prop. 8 proponents risk contempt of the court if they continue to withhold production. According to today’s order, Prop. 8 proponents are ordered to produce additional responsive documents on a rolling basis to conclude not later than the close of fact discovery on November 30, 2009.

It really makes you wonder what’s in those documents and what it is they’re trying to hide at the risk of being thrown in jail for contempt.

This is just rather sick, I would much prefer we sent 200,000 anti-gay marriage supporters over there to be slaughtered instead.

KATMANDU, Nepal — A Hindu festival in which hundreds of thousands of animals are expected to be sacrificed will go ahead as scheduled in southern Nepal despite protests, organizers said Friday.

The Gadhimai festival, celebrated every five years, is attended by many Hindus from India as well as Nepal. More than 200,000 buffaloes, pigs, goats, chickens and pigeons are expected to be slaughtered this year on Nov. 24 and 25.

Organizers said they will not bow to “interference” from animal rights and religious groups that have held protests in Katmandu and in the festival area in Bara district, about 100 miles (160 kilometers) south of the capital.

“We will not stop this centuries-old tradition now. This is our religion, belief and tradition and we will continue with it no matter what,” said Motilal Kushwa of the organizing committee.

Kushwa said thousands of people have already arrived at the site with animals meant for sacrifice next week.

Participants believe that animal sacrifices for the Hindu goddess Gadhimai will end evil and bring prosperity. Many join the festival from the state of Bihar in India, where animal sacrifices have been banned in some areas.

Critics say the killings are barbaric and conducted in a cruel manner.

Government administrator Taranath Gauram said hundreds of extra policemen have been sent to the area to maintain security and officials do not expect trouble during the festival.

Ram Bahadur Bamjan, a Nepalese teenager revered by many as a reincarnation of Buddha, has joined the campaign against the animal slaughter and plans to visit the festival area to appeal directly to participants to stop the sacrifices.

Bamjan’s followers believe he has been meditating without food and water in the jungles of southern Nepal since 2005. Believers say he spends months without moving, sitting with his eyes closed beneath a tree.

She must of being fired by now yeah? I mean, you can’t represent a truthful god fearing organization like the National Organization Against For Marriage while making sex tapes and expect to be employed still?

We’ve just received a press release from Californians Against Hate’s Fred Karger, hypothesizing that the National Organization Against For Marriage has fired it’s dazzling beauty queen, the embodiment of virtue herself, Carrie Prejean. From the press release:

Dear Maggie —

It looks like you fired former Miss California, Carrie Prejean, just like Donald Trump did back in June.

She is no longer on your web site:  nationformarriage.org I called your Washington, DC – PR firm, Mary Beth Hutchins at 703-683-5004 ext. 105, but no one was there to tell me why.   What happened to *”the future of our movement, and the future of America,” as you referred to Carrie just two months ago?

Was it because she lied again? This time she said in numerous interviews that she “made only one sex tape.”  Now it appears to be more like 15 or 20.  We just heard that from the guy she met on My Space.

He also said that Carrie asked him to lie and say that she was only 17 when she made the sex tapes.  In an interview with TMZ’s Harvey Levin, her ex said that she made the tapes when she was from 19 to 21, so not that long ago like Carrie insists.

Why did you take her off your web site?   Did you hear from a lot of your high powered Board of Directors on this?  What about your likely creator and largest backer, the Church of Jesus Christ of Latter-day Saints (Mormon Church)?  They gotta be uncomfortable with the whole multiple sex tapes thing.   You sure changed your tune, Maggie.

What do you think the chances are that NOM/Maggie will speak publicly on Carrie now?

It would appear that the National Organization Marriage’s spokesh0r isn’t too happy discussing “her lil solo sex tape”

Carrie Prejean threatened to walk off Larry King Live Tuesday night, in the middle of her interview with Larry King.

Prejean’s threats came after King asked the former beauty queen about the reasons behind her recent settlement with the Miss California USA pageant. King asked Prejean why she agreed to strike a deal with the Pageant and drop her claims of libel, slander and religious discrimination. “Why settle since you had a fight to carry on?” King pressed.

Prejean demurred. King asked again: “You can’t even say why you settled?”

Prejean, visibly displeased, refused to answer: “Larry, it’s completely confidential and you’re being inappropriate.” The inappropriate issue at hand isn’t King’s probing question, but the alleged reason why Prejean settled: TMZ reported that she decided to strike a deal only after the lawyer for the Pageant revealed a home-made sex tape of a 17-year-old Prejean. King: “So the agreement discusses the motive behind why each party agreed?” Prejean: “Larry you’re being inappropriate. You really are. So, I’m not going to talk about –” (This back and forth goes on for a full minute.) Finally, King concedes: “Okay, I, uh… inappropriate King Live continues.” He drops the subject and goes to a caller.

But the damage is done: before the person on the phone line is halfway through his introduction (“I’m a gay man and I love pageants”), Prejean reaches to disconnect her mic and mouths something to someone off camera. “Did she hear the question?” King wonders.
